Your plan is agreed before you pay.

Your exact inclusions, dates, PT allowance, payment schedule and full total are confirmed in writing. Sending an enquiry does not enrol you. Start with the FAQs, then ask Yash about anything that needs explaining.

1. Who provides the coaching

888 Performance is operated by Yashub Thadani, sole trader, ABN 69 115 959 858 (Yash, we or us). These terms cover personal training and online coaching supplied by 888 Performance.

Contact Yash on 0433 454 843 or WhatsApp. The usual PT venue is Hyprepp Fitness, Shop 11/475 Fitzgerald Road, Sunshine West, Victoria.

A separate gym membership for independent visits is a separate agreement with the gym operator. These coaching terms do not replace its membership terms. Existing paid bookings keep their agreed terms unless both parties agree a lawful change.

2. Your booking and agreement

A website enquiry or request for an initial 10–15-minute phone call does not enrol you in paid coaching or authorise a payment. After the call, you receive the package info sheet and a suitable recommendation; you may also request the info sheet before the call. Before paid services begin, you receive these terms and a written Booking Summary. Your agreement begins only after you expressly accept both, including electronically.

The Booking Summary must identify the client and, where applicable, the adult contracting parent or guardian, and confirm:

  • The selected service, goals, start and finish dates, session duration and location.
  • The exact PT allowance, whether it is per week, billing period or whole season, and how sessions are booked.
  • The complete price, onboarding fee if any, first payment, total initial commitment, payment dates and method, and treatment of any final part-period.
  • Any separately agreed travel or venue charges, pack expiry, pause arrangements and relevant service-component values for credits or refunds.

After you accept the agreement, complete the agreed intake and screening and make your agreed first payment, we confirm your start date and bookings. You receive a copy you can retain. A specifically agreed written variation may supplement these terms, but cannot remove a right that the law protects. Core inclusions will not be reduced through a later Booking Summary without your express agreement.

3. What coaching includes

Ongoing coaching includes an individual training program, one weekly check-in, appropriate program updates, feedback on up to three exercise clips each week, and general guidance on healthy eating, hydration, sleep and recovery. Your Booking Summary records any additional agreed support. After ongoing coaching signup, you receive a private shared document with your goals, weekly schedule, exercise instructions, training notes, client feedback and progress reviews. You may add notes and feedback; Yash manages programming changes. We record agreed changes and next steps there. PT-only bookings do not include ongoing online coaching or a shared coaching plan unless expressly agreed.

  • Online Coaching: a home or gym program matched to your experience, suitable equipment and goals.
  • Athlete Season Coaching: strength and conditioning planned around team training, match days and agreed season dates, with weekly progress and fatigue reviews. It includes the season PT allowance in section 4.
  • PT + Online Coaching: online support plus the agreed one or two 45-minute PT sessions each week: four or eight respectively per 28-day block.
  • PT-only sessions and packs: the booked face-to-face sessions. Ongoing online support is included only when separately agreed.

Routine messages are handled Monday–Friday, with a target response within two business days. This is not an emergency or continuously monitored service. Planned absences and suitable support or billing arrangements are discussed in advance.

4. PT sessions, access and locations

Physical PT sessions are 45 minutes. Gym access during booked sessions at Hyprepp Fitness is included. You do not need a separate membership to attend those sessions; independent gym visits require a separate membership or other venue access.

Athlete Season Coaching allowance

Athlete Season Coaching includes up to two 45-minute, one-to-one PT sessions with Yash at Hyprepp Fitness across the entire agreed coaching season. This is a season allowance, not two sessions per week or per billing period. We agree a suitable allocation and booking plan before enrolment. Additional sessions require a separate agreement.

Please arrange included sessions during the agreed season. If you request a booking with reasonable notice and we cannot supply a suitable appointment, we arrange a fair extension, replacement or appropriate credit/refund for that component. Timely rescheduling rights are preserved if a make-up needs to fall after the season end.

Off-site PT by separate agreement

Other locations require advance agreement, suitable equipment and any necessary venue permission. There is no travel surcharge for an agreed location within a 5 km radius of our service base. Beyond that radius, a travel surcharge is quoted and agreed before booking. Provide the proposed venue during your consultation so Yash can confirm the position. Any venue-entry charges are also confirmed beforehand. The included athlete sessions remain at Hyprepp Fitness.

5. Fees, billing and renewal

All agreed prices are in Australian dollars. Your written quote shows the full payable amount, including any applicable taxes and mandatory charges. There are no undisclosed setup, travel or exit fees.

Ongoing coaching is ordinarily billed every 28 days, which is a four-week period, not a calendar month. Online Coaching and PT + Online Coaching have an initial agreed 12-week term, followed by a review. Continuation requires agreement; it is not automatic.

Athlete Season Coaching follows individually agreed start and finish dates. Its payment schedule and full season total are confirmed before enrolment, including any final part-period. Billing stops at the agreed season finish unless a new arrangement is expressly agreed.

Any onboarding fee is itemised and covers the separate training consultation, assessment and initial program preparation. The initial suitability phone call is separate from this paid onboarding service. It is charged once for a new coaching client, not again merely for switching tiers. PT-only and introductory sessions have no coaching onboarding fee. Refund treatment depends on work actually supplied and your consumer rights.

Direct debits require separate authorisation. Paid sessions retain their agreed rate. Future price increases require at least 28 days’ written notice and your agreement before renewal; fixed-term prices do not change without agreement. Any greater protection in an existing contract remains.

6. Booking changes and missed sessions

  • At least 24 hours’ notice: move a PT session without a cancellation charge. We offer reasonable alternative appointments and arrange a make-up within 28 days. If we cannot offer a suitable appointment in that time, we agree an extension or appropriate credit/refund.
  • Less than 24 hours’ notice or a no-show: a charge or credit deduction may reflect actual, reasonable unrecovered loss, capped at the agreed value of that session. We consider illness and emergencies and explain any amount claimed.
  • No double recovery: we do not both deduct a session and impose another charge for the same loss. If a slot is resold without loss, there is no loss charge. A partial loss results in only an equivalent credit deduction, with the balance retained.
  • If Yash cancels: you can arrange a suitable replacement or receive an appropriate credit/refund for the undelivered service. Other consumer remedies remain available.

Please arrive on time. A late arrival may shorten the appointment where another booking follows; it does not automatically create an additional fee. Tell Yash promptly if you need to change a booking.

7. PT packs and expiry

New ten-session packs contain ten 45-minute PT sessions and are paid upfront. Their standard validity is six months from purchase, with the actual expiry date shown on your receipt. Existing packs retain their agreed expiry. Any longer validity required by law applies.

Contact Yash before expiry where possible if illness, injury, gym closure or appointment availability affects use. We consider reasonable extensions and resolve any overlap between a timely make-up and expiry fairly. Our inability to supply a session does not cause you to lose its value.

The cancellation and consumer-rights provisions below also apply to packs. Unused sessions are not automatically forfeited merely because you ask to end an arrangement.

8. Pauses, ending coaching and refunds

Contact Yash if illness, injury or another change affects participation. We discuss a suitable adaptation, pause or end date, the effect on billing and any revised dates, and confirm the agreed arrangement in writing. Reasonable supporting information may be requested where necessary; a full medical history is not routinely required.

You may request early cancellation at any time. An initial term is an agreed coaching period, not permission for a blanket forfeiture or automatic claim for every remaining payment. For a change-of-mind cancellation, any amount retained or charged is limited to the agreed, reasonable value of services already supplied and reasonable, documented costs directly and unavoidably caused by ending early. We take reasonable steps to reduce loss and do not recover the same amount twice.

We provide an itemised calculation. Any cancellation-related amount will not exceed the remaining agreed price. Unused prepaid amounts beyond any lawful deduction are refunded without unreasonable delay. Refunds use agreed package/component values; delivered services are not retrospectively repriced at a higher single-session rate to remove a discount.

Consumer-law refunds are separate and take priority where applicable. A paid onboarding fee is not automatically non-refundable: its treatment depends on work actually performed and any legal entitlement to a refund. We stop future billing from the confirmed effective end date, subject only to properly itemised amounts lawfully owed.

Any statutory cooling-off right applies in full. If an agreement is an unsolicited consumer agreement, the required cancellation information, cooling-off restrictions and refund rules apply; these general terms do not replace the documents required for that sale. We do not take payment or supply services during a statutory period where that is prohibited.

You can give notice by calling or messaging Yash. A written message helps both parties keep a record, but is not a condition for exercising a legal cancellation right. A valid notice does not wait for our approval or acknowledgement to take effect.

9. Health, suitability and exercise safety

Before training, complete the agreed screening and tell Yash about relevant injuries, symptoms, conditions, medicines, pregnancy or other circumstances that may affect exercise. Keep that information reasonably up to date. Where a particular safety concern warrants it, we may seek suitable clearance or advice from an appropriately qualified health professional before proceeding.

Coaching provides exercise instruction and general healthy-eating and lifestyle guidance. Medical diagnosis, treatment, injury rehabilitation and therapeutic diets are outside this service. Yash holds Certificate III & IV in Fitness and undertakes ongoing professional development in biomechanics.

Exercise involves risks, including strain or injury. Follow reasonable instructions, use suitable equipment and a clear training space, and stop and seek appropriate help if you experience concerning symptoms. For online training, tell Yash if you cannot safely follow an exercise so it can be adapted.

These responsibilities do not excuse us from providing services with the care and skill required by law, and do not waive a claim for negligence or another legal right.

10. Athletes under 18

For an athlete under 18, a parent or legal guardian must be the adult contracting party and participate in enrolment, consent and the discussion of goals, fees, season dates and training load. Training is adapted to experience, school and sport commitments.

We agree appropriate communication and parent/guardian involvement while respecting applicable privacy requirements and the young person’s circumstances. The athlete must follow reasonable safety instructions and can raise concerns about any exercise or interaction.

11. Goals and progress

We agree suitable goals and review training consistency, exercise technique, recorded training progress and relevant habits. Athlete programming considers team training, match demands and fatigue.

Individual outcomes depend on starting point, participation, health, recovery and other circumstances. We do not promise a particular weight change, muscle gain, team selection or professional contract. This does not reduce any service promise actually agreed with you or any consumer guarantee.

12. Conduct, safety and service changes

Both parties must communicate respectfully and follow reasonable venue and safety rules. Yash may stop an individual session where an immediate safety concern requires it. Any ongoing suspension or termination must have a reasonable basis, be proportionate and be explained; where appropriate, you receive an opportunity to resolve the issue.

If a payment is overdue, we contact you and allow a reasonable opportunity to correct a genuine error or discuss the issue before suspending future service. No arbitrary penalty or undisclosed collection fee applies. Fees for coaching we do not supply are handled fairly under these terms and the law.

Training progressions and exercise substitutions are normal coaching decisions. Material changes to agreed inclusions, access, venue or support require discussion and agreement. If we cannot provide an important part of the agreed service, we offer an appropriate alternative or relevant cancellation/refund remedy. We do not replace consumer rights with compulsory store credit.

13. Your information, videos and programs

We use information needed for enquiries, screening, coaching, bookings and billing. Health information and exercise videos are handled with consent where required and only for appropriate service purposes. Collection details and relevant communication/storage services are explained before sensitive coaching information is collected. Each shared coaching document has restricted access for the individual client and Yash, with parent/guardian access where agreed. One client’s plan is not shared with other clients. We agree the document platform and appropriate access before sharing.

The website enquiry form prepares a WhatsApp message without saving its entered details to this website. WhatsApp handles messages under its own policies. Ask Yash about an appropriate channel before sending medical documents or other sensitive material. You may contact Yash to request access to, or correction of, your personal information or to raise a privacy concern.

We do not publish your name, photos, videos or results for marketing without separate, specific permission. Consent to coaching is not marketing consent. Your submitted material remains yours; we use it only as reasonably needed for the service and agreed purposes.

Programs and coaching resources supplied by us are for your personal training. You may share them with your treating health professional or parent/guardian as appropriate. Do not sell or publicly republish them without permission.

14. Consumer rights and responsibility

Nothing in these terms excludes, restricts or modifies a right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified. Services must meet applicable Australian Consumer Law guarantees, including due care and skill, relevant fitness for purpose and reasonable timing.

If services do not meet those guarantees, you may be entitled to a remedy such as fixing the problem, cancellation, a refund or compensation, depending on the circumstances. These terms do not impose a blanket “no refunds” rule, exclude negligence or require you to release a personal-injury claim.

Where a term conflicts with a non-excludable legal protection, that protection prevails. The remaining lawful terms continue to operate where possible.

15. Questions, complaints and future changes

Raise a concern with Yash on 0433 454 843 or WhatsApp. Explain the booking, issue and outcome you are seeking. We aim to acknowledge a complaint within two business days and work towards a fair resolution promptly.

You may seek help from Consumer Affairs Victoria or the appropriate agency where you live, and use an available court or tribunal. Internal discussion is not a compulsory barrier to a legal remedy.

These terms apply to new bookings accepted with this version. We do not retrospectively change paid agreements by updating this page. Material changes to an existing agreement require notice and agreement, subject to any greater legal protection.

Victorian and Australian law apply, subject to any mandatory protections where you live. No exclusive-jurisdiction clause limits a consumer right to bring a claim elsewhere.

Independent information is available from the ACCC on consumer guarantees, Consumer Affairs Victoria on cancelling services and unfair terms in fitness contracts.
